Terms of Service

By creating an account or using CustodyTrac, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the service. These terms apply to all users of CustodyTrac, including both account holders and co-parents who join a shared family space.

CustodyTrac is a co-parenting coordination platform that provides: • Shared custody calendar management • Custody day swap request and approval workflows • Shared expense tracking and reimbursement management • In-app and email notifications • Family member invitation and management We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

To use CustodyTrac, you must: • Be at least 18 years old • Provide accurate and complete registration information • Maintain the security of your account credentials • Notify us immediately of any unauthorized account access • Accept responsibility for all activity under your account You may not create accounts for others without their consent, or use CustodyTrac on behalf of another person without authorization.

You agree to use CustodyTrac only for lawful purposes and in accordance with these terms. You must not: • Use the service to harass, threaten, or intimidate your co-parent or any other person • Upload false, misleading, or fraudulent information • Attempt to gain unauthorized access to other accounts or systems • Use the service in any way that violates applicable laws or court orders • Reverse engineer, decompile, or attempt to extract source code • Use automated tools to scrape or extract data from the service We reserve the right to suspend or terminate accounts that violate these terms.

CustodyTrac is provided free of charge to all users. There are no subscription fees, paid plans, or charges of any kind for either parent. We reserve the right to introduce optional paid features in the future. If we do, existing free features will remain free and users will be given clear notice before any charges apply.

Your use of CustodyTrac is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the service, you consent to our collection and use of data as described in the Privacy Policy. You retain ownership of all content you submit to CustodyTrac. By submitting content, you grant us a limited license to store, process, and display it solely for the purpose of providing the service to you.

CustodyTrac may allow you to upload, store, and share documents, images, receipts, court orders, medical records, school records, and other files ("Uploaded Content") through features such as the Document Vault and expense receipt tools. You are solely responsible for all Uploaded Content. By uploading any content, you represent and warrant that: (a) you own the content or have all rights, licenses, consents, and permissions necessary to upload, store, and share it, including any consents required from third parties or on behalf of a minor child; (b) the content is accurate, current, and lawfully obtained; (c) uploading and sharing the content does not violate any applicable law, regulation, court order, protective order, custody agreement, or the privacy or other rights of any third party; and (d) the content does not infringe any intellectual property, privacy, or other right of any person. CustodyTrac does not review, verify, authenticate, or endorse the accuracy, completeness, legality, or genuineness of any Uploaded Content. We are not a party to, and assume no responsibility for, the content, character, or purpose of any document you upload. Uploaded Content is made available to other family members you add to your family space (and, where applicable, significant others, attorneys, or mediators you grant access to) at your sole direction and risk. We provide no warranty, guarantee, or representation — legal, regulatory, evidentiary, or otherwise — regarding Uploaded Content, including without limitation any warranty that it is suitable for use as evidence in a legal proceeding, complies with any applicable privacy or data protection law, or satisfies any recordkeeping or disclosure obligation you may have under a custody order, court rule, or other legal requirement. You agree to indemnify, defend, and hold harmless CustodyTrac, Inc. and its officers, directors, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your Uploaded Content or your breach of this section. We reserve the right, but assume no obligation, to remove, disable access to, or refuse to store any Uploaded Content at any time, with or without notice, including content we believe may violate these Terms, applicable law, or the rights of a third party.

CustodyTrac is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that: • The service will be uninterrupted or error-free • Any information provided is accurate, complete, or current • The service is suitable for use as legal documentation in court proceedings We strongly recommend consulting a family law attorney for legal advice. CustodyTrac is a coordination tool, not a legal service.

To the maximum extent permitted by law, CustodyTrac and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including any damages arising from Uploaded Content. Our total liability to you for any claims arising from these terms or your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim.

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Maricopa County, Arizona.

We may update these Terms from time to time. We will notify you of material changes by email and in-app notice at least 14 days before the change takes effect. Continued use of CustodyTrac after the effective date constitutes acceptance of the updated terms.
